Vegetable powder nitrate enters a cured meat recipe on the ingredient line. It never shows up next to E 249 or E 250. Since 9 October 2025 that split stopped helping the recipe. Vegetable powder nitrate sits inside a limit set for all sources
The condition on nitrite in meat says nothing about what you add. It reads: “The maximum residual amount from all sources for the product ready for marketing throughout the shelf-life of the product shall not exceed” the figure set for that category, as NO2 ion.
Three parts of that line drive the recipe. First, it covers all sources. Nitrite from a vegetable powder counts like nitrite from curing salt. Second, it measures the product ready for marketing. So the number belongs to the finished good. Third, it runs through shelf life. A single release test at day zero leaves half the question open.
That changes what a development brief has to hold. When a recipe leans on a nitrate rich powder for its cure, the nitrate load turns into a design input. It needs a tolerance, in the way salt or water activity carries one.
What Regulation 2023/2108 changed in the numbers
The lower figures for potassium nitrite (E 249) and sodium nitrite (E 250) apply from 9 October 2025. Stock placed on the market before the date of application may run to its date of minimum durability. So older packs did not have to leave the shelf that week.

Every figure states nitrite as NO2 ion. Traditional cured products in category 08.3.4 keep their own provisions. Added amounts there run 30, 65, 100 or 105 mg/kg, with separate residual conditions. So a traditional line needs its own read of the annex.
British and Irish plants face a second layer. Food Manufacture reports that the EU cuts have applied since October 2025, while the UK kept its levels after a review of the evidence. One recipe and one artwork no longer serve both markets.
When a vegetable powder becomes a food additive
Regulation (EC) No 1333/2008 sets the test in Article 3(2)(a). A food additive is a substance not normally eaten as a food in itself. It is also one not normally used as a characteristic ingredient of food. You add it for a technological purpose. So the test turns on purpose.
The same article lists what stays outside. Point (ii) excludes “foods, whether dried or in concentrated form, including flavourings incorporated during the manufacturing of compound foods, because of their aromatic, sapid or nutritive properties together with a secondary colouring effect”. A dried vegetable used for taste, aroma or colour stays an ingredient.
Curing is a technological purpose. A powder picked for that job falls outside the exclusion. The Commission page on additives sets out the same logic. EU law names technological purposes such as preservation. Only substances on the EU list may serve them.
Article 18 of the same regulation handles carry over. An additive may be present in a compound food when it is permitted in one of the ingredients. It may also ride in through an additive, enzyme or flavouring, so long as it has no technological function in the final food. So a nitrate rich powder that does cure the meat cannot shelter under that route.
The Standing Committee applied this to plant extracts. As FoodNavigator reported, an extract with a technological function “is deemed to meet the definition of a food additive and so it shall comply with the conditions set out in the food additive legislation”. Write the intended function of every vegetable powder into the product file. That one word decides which rulebook applies.
Vegetable powder nitrate moves with the crop, so pin a range
Nitrate in vegetables shifts with species, soil, season and light. EFSA notes that fruit and vegetables give over half of all dietary nitrate, and as much as two thirds. Green leafy crops such as spinach, lettuce and rocket sit highest.
Survey data of that kind covers fresh produce. Freeze drying takes out the water, while the nitrate stays in the solids. The same nitrate then sits in a fraction of the mass. A number for the fresh crop tells you little about the powder in the sack.
Two things follow for the spec. Ask for nitrate measured on the powder as delivered. Ask for the spread across recent lots as well, because a mean value hides the batch that tips your finished product over the limit.
Seasonal supply adds a second variable. When a powder comes from more than one growing region across the year, the nitrate range widens. So agree the acceptance limit before the first delivery, and write it into the contract, because an email trail will not hold up at audit.
ANSES made the point plainly once plants began to replace curing salts. FoodNavigator quoted its warning that plant extracts and vegetable broths hold nitrates which bacteria turn into nitrites. That creates “hidden nitrates and nitrites” in packs sold as zero nitrite.
What to ask for on the COA
A good COA answers five questions with no follow up call. Each one maps to a line an auditor can check., Nitrate as NO3 in mg/kg, measured on the powder as delivered., The method used, with its limit of quantification., Moisture in the tested sample, so the figure has a basis., Lot code, tied to the delivery note., The sampling plan, including how many increments made up the sample.
Keep the sum that turns those numbers into a dose in your recipe. When the dose changes, the sum gets a new version. Then the finished good needs fresh residual data across shelf life.
Work the sum in the same units every time. Take the nitrate figure in mg/kg on the powder, then multiply by the dose as a fraction of the batch. That gives the nitrate the powder brings to the meat. Since curing flora reduce only part of it, the nitrite you measure later will differ. So the sum sets a ceiling for planning, while the finished product test settles the answer.
The exposure data behind the cut
EFSA re-checked both groups of additives and confirmed the daily intakes: 0.07 mg per kg of body weight per day for nitrite, 3.7 mg per kg for nitrate. Nitrate from additive use came to under 5 % of total nitrate exposure. It stayed inside the safe level.
The picture shifted once all sources went into the model. EFSA found that the safe level may be passed for people of all age groups with medium to high exposure. That finding drove the cuts.
Nitrosamines carried the rest of the case. In a draft opinion of 12 October 2022, EFSA concluded that “it is highly likely that for all age groups dietary exposure to nitrosamines is above the level that could indicate a health concern”. Cured meat sits among the foods where they show up.
Plants had already begun to move. The National Pig Association told FoodNavigator that some processors cut ingoing nitrite by up to 60 %. Writers in New Food Magazine stress that EFSA modelled natural sources in vegetables and water next to additives.
Vegetable powder nitrate reads differently outside the EU
In the EU the powder shows on the ingredient list under its own name. No protected claim wording exists for a cure built on it. Any words on pack still have to be accurate for the shopper.
The US took another route. A petition filed with FSIS records that meat cured with celery powder has carried “Uncured” and “No Nitrate or Nitrite Added” on pack. It asks the agency to stop that wording for any product made with a nitrate source.
So one recipe shipped to several markets needs three reads. The residual rule in the EU comes first. Then the national line in the UK. Last, the label words in the US. Five documents close most questions.
